Stockwatch has referenced an article written by David Baines in 2012, whereby he misrepresents and falsifies information regarding James Alexander Michie.
In this article David Baines implies that Erwin Speckert, a convicted criminal, has close ties to James Alexander Michie.
Here are the facts:
In 2005, Speckert was employed by a company in which James Alexander Michie served as Chairman. Speckert was terminated with cause shortly after one year of employment for misappropriating corporate funds for his personal use. That was May 2006.
Since May 2006 there has not been any contact between James Alexander Michie and Erwin Speckert.
A few years after his dismissal, Speckert contacted James Alexander Michie’s first wife, who he ended his relationship with in 1995, to encourage and help facilitate a revenge lawsuit against Michie and his second wife–whom he married in 2004.
A lawsuit was initiated. It was a total litigation disaster. James Alexander Michie saw all relief sought against him to be denied. The trial judge also stated his second wife “should have never been involved in the case.”
Speckert was the key witness and the trial judge concluded the following on his testimony about James Alexander Michie:
Mr. Speckert’s manner of testifying was unusual. He often did not answer questions directly or have specific evidence to give to backup an assertion, instead answering with analogies or assumptions. His alleged motivation for testifying “truthfully” at trial as opposed to the information provided to the court at the chambers hearing in 2005 was that he was outraged at unfairnesses perpetrated on Ms. Waters. This is simply not credible. He clearly has an animus towards Mr. Michie which colours all of his evidence.
Six years after being terminated for cause by James Alexander Michie and the board of directors of Alpine Atlantic Asset Management AG, Erwin Speckert was charged criminally with money laundering in 2012. He was later convicted and sentenced to serve three years in prison in Canada. At about the same time, he ran afoul with the BCSC, and was banned from the capital markets for 5 years.
James Alexander Michie has no criminal record and has never been sanctioned by securities regulators.
It should also be noted that David Baines never bothered to contact or question James Alexander Michie before writing his untruthful and slanderous article.
